What are e-Delivery and what do they replace?
- e-Delivery is a fast and secure way of exchanging important information, formal documents in electronic form. e-Delivery ensure legally effective transmission of e.g. contracts, orders, decisions or various types of confirmations, summons or appeals. e-Delivery are able to replace traditional paper correspondence and less secure forms of electronic communication such as e-mail.
Who is obliged to implement e-Delivery?
- Any entity and individual can use e-Delivery services. In Poland, the Act on electronic delivery introduces an obligation for Public Entities, entrepreneurs and other organisations to have an e-Delivery address for communication with Public Entities and, in indicated cases, also for communication with clients and contractors.
What is the timetable for implementation?
- There is currently a voluntary period for the use of e-Delivery, but we must remember that from October 5th, 2021, the obligation to receive correspondence in the e-Delivery channel starts as soon as we obtain an e-Delivery address. For entities that do not yet have an e-Delivery address, the obligation will be phased in from January 1st, 2025. Details of the timetable are described later in the Report.
What are the main benefits of using e-Delivery?
- The main advantage of using e-Delivery is their accessibility, i.e. we can use them from any place and at any time, without the need to go to, for example, a post office or order a courier service. The security and confidentiality of the correspondence is ensured by trust service providers under supervision and subject to cyclical detailed audits carried out by a dedicated external Evaluation Unit in compliance with the eIDAS Regulation.
Identification of parties and proofs – each e-Delivery provider is responsible for confirming the sender and addressee and only provides these parties with the information transmitted, which at all other times is encrypted and protected against unauthorised access, and for each relevant stage of delivery issues a confirmation – called a proof in trust services because of its legal effect confirming in particular the sending and receipt of the correspondence, as well as the details of the sender and addressee.
Who is the provider of this service on the Polish market?
- In Poland, we can use the services of several providers providing a qualified e-Delivery service or choose a public service provided by a designated operator. More details can be found in this report.
